Terms and conditions

Creative services terms and conditions

These terms apply between you (the client) and Megan Clark trading as megmakes.me, ABN 42 868 473 568 (“megmakes.me”, “we”, “us”). They apply from 14 October 2026.

1. Acceptance

By using our services, accepting a proposal or paying a deposit invoice, you agree to these terms. Your project proposal and these terms together form the whole agreement.

2. Your responsibilities

You’ll supply the materials your project needs (such as text, images, logos and fonts), give feedback and approvals on time, and pay invoices by their due dates. If materials or approvals arrive late, launch dates may move, and we’re not responsible for delays this causes.

3. Content and copy

We don’t write copy unless it’s included in your proposal. Substantial copywriting requires a separate, approved quote. Late content may extend timelines and add charges. We only buy stock images with your written approval.

4. Templates and plugins

We carefully choose third-party themes and plugins, but we’re not responsible for their quality, compatibility, responsiveness or ongoing support. Customisations beyond a theme’s built-in options are quoted separately.

5. Proofing and approvals

You’re responsible for checking all content and designs before approval. Changes requested after you approve a final version are billed at our hourly rate.

6. Changes to scope

Changes to the agreed scope will receive a new quote and timeline. Change requests must be made in writing. Rework caused by a changed or incorrect brief is billed at our hourly rate.

7. Hosting, accounts and data

Domains, hosting and third-party accounts should be held in your name, and you’re responsible for keeping them paid and active. Unless you’re on a maintenance plan with us, you’re responsible for backups, security updates and plugin updates after launch. You’re responsible for complying with privacy laws for any data your website collects, including form submissions.

8. Website security

No website or online system can be completely secure. We follow reasonable security practices when building and maintaining websites, but we don’t guarantee your website will be free from hacking, malware, spam or data breaches. Unless you’re on a maintenance plan that includes security updates and monitoring, ongoing security is your responsibility. To the extent permitted by law, we’re not liable for losses caused by unauthorised access, malicious attacks, or vulnerabilities in third-party software, plugins or hosting.

9. Third-party services

We’re not liable for losses caused by outages, changes or loss of access to third-party platforms, including hosting providers, website builders, plugins and payment services.

10. Support and training

Support requests (including calls, emails, meetings, consultations and updates) are billed at our hourly rate, with a minimum charge of 30 minutes. Training is billed at our hourly rate unless included in your proposal.

11. Warranty

We fix defects in code we wrote for 3 months after launch at no charge. This doesn’t cover issues caused by third-party updates, hosting changes or edits made by others. After that, fixes and maintenance are billed at our hourly rate or under a maintenance plan.

12. Refunds

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Beyond those, deposits are non-refundable and we don’t offer refunds on work completed.

13. Payments

Projects require a non-refundable deposit before work begins, with further payments at the milestones set out in your proposal. Invoices are due within 14 days, in Australian dollars, by bank transfer to the account shown on the invoice. Overdue amounts may incur interest at 10% per year, and you’ll be responsible for reasonable collection costs. We may withhold final files and launch until final payment is received.

14. Cancellation and termination

Either party may end a project with 14 days’ written notice. You’ll pay for work completed and expenses incurred up to that date, billed at our hourly rate. We may pause or end work if invoices are more than 30 days overdue.

15. Copyright and intellectual property

On full payment, you own the final website content and designs created specifically for you. megmakes.me keeps ownership of its pre-existing code, templates, tools and know-how, and grants you a perpetual licence to use them as part of your website. Concepts and designs you didn’t select remain ours and may be reused. Third-party themes, plugins, fonts and images are licensed under their own terms.

You’re responsible for having permission to use any materials you supply, including fonts and images. While our work is original to the best of our knowledge, we can’t guarantee it won’t conflict with third-party rights we’re unaware of. We may display completed work in our portfolio unless you ask us not to in writing.

16. Subcontractors

We may use subcontractors for parts of a project, such as printing or specialist development. We remain responsible for their work, and they’re bound by the same confidentiality obligations.

17. Privacy and confidentiality

We won’t share or sell your details without your permission, and we’ll only contact you about your work with us. Please tell us in writing before the project starts if any materials are confidential. We’ll keep your confidential information private, and you’ll do the same for our pricing, proposals and processes.

18. Liability

To the extent permitted by law, megmakes.me isn’t liable for any indirect or consequential loss, including lost profits, revenue or data, arising from your website or its operation. Our total liability for any claim arising from a project is limited to the fees paid for that project in the 12 months before the claim. Where the Australian Consumer Law applies, our liability is limited to resupplying the services or paying the cost of having them resupplied. If any part of these terms is unenforceable, the rest still applies.

19. General

These terms are governed by the laws of Western Australia. We may update these terms from time to time, and the version in place when you accept a proposal applies to that project.

  • supervising children using templates, scissors or craft knives
